Trademark Rules

The name "smarthomatic" (called "word mark" in the following paragraphs) is a registered word mark of Uwe Freese (Munich, Germany).

The word mark may be used to describe the original parts of the project, which are available on the website, the wiki and the source code repository, as well as for genuine hardware, which is or was sold at the online shop https://www.smarthomatic.org/shop/.

The word mark may not be used for derived, modified variants of hard- or software or completely different products or hardware (PCBs or devices), which are or were not sold at the online shop mentioned above. It may not be used as a part of a company name, product name or domain name without explicit agreement from the owner of the word mark "smarthomatic". It may not be used to create a false impression of the project or product or to damage the reputation of the word mark.

A slightly modified name which could easily be confused with "smarthomatic" may not be used for similar products in accordance to the trademark law.

But the word mark may be used to indicate compatibility of other products which are indeed compatible with smarthomatic, but only when an appropriate remark (like "compatible with") is added, and not as the name of the product itself. In this case, the own name has to be visible more prominent than the word mark "smarthomatic".

When using the word mark, a link to the website of the project http://www.smarthomatic.org has to be added.

Incidentally, the trademark protection law has to be followed.

Copyright of the Logo

The logo (the "house") and logotype may only be used for the description of or in connection with the project smarthomatic, as described on the website and in the repository. They must not be used in conjunction to modified or completely other software or hardware products.

The logo and logotype may be used on hardware (boards or devices) or description of those only for private purposes for devices included in the project repository and which are therefore available to the public. For derived or modified versions, devices not existing in the repository, completely different products or for commercial boards or devices or to describe them, they must not be used without explicit permission from Uwe Freese.

When using the logo or logotype, a reference to the project smarthomatic has to be included by mentioning the name "smarthomatic" or the website http://www.smarthomatic.org. The logo and logotype may only be used in unmodified form. Scaling is allowed. The color must be either as shown on the website http://www.smarthomatic.org or solid black, white or gray. The color may be different on boards if technically necessary.

Benutzungsbedingungen für die Marke "smarthomatic"

Der Name "smarthomatic" (im Folgenden als "Wortmarke" bezeichnet) ist eine eingetragene Wortmarke von Uwe Freese (München).

Die Wortmarke darf verwendet werden zur Bezeichnung oder Beschreibung von originalen Bestandteilen des Projekts, die auf der Webseite, im Wiki oder im Source Code Repository zu finden sind, sowie für Original-Hardware, die durch den Online-Shop https://www.smarthomatic.org/shop/ vertrieben wird oder wurde.

Die Wortmarke darf nicht verwendet werden für abgeleitete, modifizierte Varianten von Hard- und Software oder komplett andere Produkte sowie für Hardware (Platinen oder Geräte), die nicht durch den o.g. Online-Shop vertrieben wird oder wurde. Er darf auch nicht als Bestandteil eines Firmen-, Produkt- oder Domain-Namens ohne Einwilligung des Markeninhabers benutzt werden. Er darf nicht genutzt werden, um das Projekt oder Produkt in einem falschen Licht darzustellen oder den Ruf der Marke zu beschädigen.

Ein nur leicht veränderter, leicht zu verwechselnder Name, darf entsprechend des Markenschutzrechts nicht für ähnliche Produkte verwendet werden.

Die Wortmarke darf jedoch verwendet werden, um auf die Kompatibilität von anderen mit smarthomatic kompatiblen Produkten hinzuweisen, jedoch nur mit entsprechendem Vermerk (wie "compatible with smarthomatic") und nicht als Bezeichnung der anderen Produkte. In diesem Fall muss der eigene Name mehr hervorgehoben sein wie die Wortmarke "smarthomatic".

Bei Verwendung des Markennamens muss immer ein Verweis auf die Webseite des Projekts http://www.smarthomatic.org angegeben sein.

Im Übrigen ist das Markenschutzrecht einzuhalten.

Urheberrecht für das Logo

Das smarthomatic Logo (das "Haus") und der Schriftzug sind urhebberrichtlich geschützt (c) 2013 durch Uwe Freese.

Das Logo und der Schriftzug dürfen nur verwendet werden zur Beschreibung oder im Zusammenhang des Projekts smarthomatic, wie es auf der Webseite beschrieben und im Repository vorhanden ist. Es darf nicht verwendet werden in Verbindung mit abgewandelten oder komplett anderen Software- oder Hardware-Produkten.

Auf Hardware (Platinen oder Geräten) oder zur Beschreibung derselben darf das Logo oder der Schriftzug nur für private Zwecke für solche Hardware genutzt werden, die im Projekt-Repository beschrieben und somit der Allgemeinheit zugänglich gemacht sind. Sie dürfen für daraus abgeleitete, modifizierte Varianten, nicht im Repository beschriebene Hardware oder komplett andere Produkte und für kommerzielle Platinen oder Geräte jeglicher Art oder zur Beschreibung derselben nur nach expliziter Erlaubnis verwendet werden.

Bei Verwendung des Logos oder des Schriftzugs muss immer ein Verweis auf das Projekt smarthomatic vorhanden sein in Form der Erwähnung des Namens "smarthomatic" oder der Webseite http://www.smarthomatic.org. Das Logo und der Schriftzug dürfen nur in unmodifizierter Form verwendet werden. Skalierung ist erlaubt. Die Farbe muss entweder wie auf der Webseite http://www.smarthomatic.org abgebildet oder einfarbig schwarz, weiss oder grau sein. Auf Platinen sind andere Farben je nach technischer Notwendigkeit erlaubt.

Urheberrecht von Wiki-Inhalten

Im Gegensatz zu dieser Webseite steht der Inhalt im Wikis (http://www.smarthomatic.org/wiki) unter der Creative Commons Attribution-Noncommercial-Share Alike 3.0 Unported Lizenz (CC BY-NC-SA 3.0) und wird von der Community des Open Source-Projects "smarthomatic" geschrieben.
